These Terms of Service govern access to and use of Peaceful Path Memorial and related PCS websites, beta programs, software, workflows, support, and services. By creating an account, accepting an invitation, completing onboarding, or using the services, you agree to these Terms on behalf of yourself and, if applicable, the organization you represent.
Acceptance and Authority
If you use the services for an organization, you represent that you have authority to bind that organization to these Terms. The organization is responsible for the acts and omissions of its owners, administrators, staff, contractors, invited users, and other authorized users.
If you do not agree to these Terms or do not have authority to accept them for the organization, do not use the services.
Services
The services are software tools designed to assist customers with business operations, workflow management, recordkeeping, case tracking, intake, status updates, reporting, communication, and related administrative functions.
PCS may update, modify, suspend, improve, limit, or discontinue parts of the services over time, including beta features and early-access workflows.
Accounts and Authorized Users
Customers are responsible for managing organization settings, authorized users, roles, permissions, account credentials, and access to customer data.
Customers must promptly remove access for users who no longer need it and must notify PCS if they suspect unauthorized account access or misuse of the services.
Customer Data and Records
Customer retains ownership of customer data entered into the services. Customer grants PCS the rights needed to host, process, transmit, display, back up, secure, support, and otherwise operate the services.
Customer is responsible for reviewing, correcting, preserving, exporting, and retaining all records required for its business, legal, regulatory, insurance, tax, operational, and customer-service obligations.
PCS is not responsible for errors, omissions, inaccuracies, delays, misidentification, duplicate records, incomplete records, incorrect selections, failed scans, user mistakes, device failures, printer failures, label failures, integration failures, or other issues caused by customer, authorized users, third-party systems, physical processes, or operational practices outside PCS control.
Acceptable Use
Customer and authorized users may not misuse the services, interfere with service operation, attempt unauthorized access, bypass access controls, upload malicious code, violate applicable law, infringe third-party rights, scrape or extract data without authorization, or use the services to process unlawful, deceptive, abusive, or harmful content.
PCS may suspend access if it reasonably believes use of the services creates security, legal, operational, or abuse risk.
Chain of Custody and Customer Responsibility
The services do not perform, supervise, verify, certify, guarantee, or control any physical handling, transport, storage, identification, cremation, processing, packaging, return, disposal, or chain-of-custody activity involving any animal remains, cremated remains, memorial items, or related property.
Customer is solely responsible for all real-world operations conducted by customer, its personnel, contractors, facilities, transport providers, veterinary partners, crematories, aftercare providers, and other service providers.
Customer acknowledges that the accuracy and completeness of records generated through the services depend on the information entered, uploaded, scanned, selected, confirmed, or approved by customer and its authorized users. PCS does not independently verify customer data, chain-of-custody entries, staff actions, timestamps, scanned identifiers, case statuses, reports, certificates, labels, invoices, service selections, or other records created or maintained through the services.
No feature, report, log, certificate, workflow, scan, timestamp, status, notification, or other output of the services constitutes an independent verification, certification, audit, guarantee, or warranty that customer has properly handled, identified, cremated, processed, returned, or disposed of any pet, remains, cremated remains, memorial item, or related property.

No Possession or Control
PCS does not take possession, custody, or control of any animal, animal remains, cremated remains, personal property, urn, keepsake, memorial item, medical record, physical tag, or physical chain-of-custody material.
Customer remains solely responsible for all such property and for all acts or omissions relating to its handling, storage, transport, processing, return, or disposal.
Representations to Third Parties
Customer shall not represent to any pet owner, veterinary practice, business partner, regulator, court, insurer, or other third party that PCS guarantees, certifies, audits, supervises, or verifies customer chain-of-custody practices, cremation practices, identity controls, custody procedures, or service performance unless PCS has expressly agreed to that representation in a separate written agreement signed by PCS.
Customer is solely responsible for adopting and enforcing its own written operating procedures, staff training, physical custody controls, discrepancy protocols, incident response procedures, customer disclosures, consent forms, service descriptions, and legal compliance program.
Templates and No Professional Advice
PCS may provide templates, workflow suggestions, sample fields, reports, labels, status options, configuration recommendations, or implementation materials. These materials are provided for general software implementation purposes only.
PCS does not provide legal, regulatory, insurance, veterinary, funeral, crematory, tax, accounting, or compliance advice. Customer is responsible for consulting its own advisors, regulators, and industry professionals.
Third-Party Services
The services may integrate with or rely on third-party services, platforms, payment processors, hosting providers, email providers, messaging tools, analytics providers, or customer-selected integrations.
PCS is not responsible for third-party services outside PCS control, and customer use of those services may be subject to separate terms, policies, fees, and availability limits.
Fees and Subscriptions
Paid plans, beta pricing, subscription terms, usage limits, renewal terms, taxes, payment methods, cancellation rules, and related commercial terms may be described in an order form, subscription checkout, plan page, invoice, or separate written agreement.
If there is a conflict between these Terms and a signed written agreement between PCS and customer, the signed written agreement controls for that customer to the extent of the conflict.
Privacy
PCS handles personal information as described in the Privacy Policy. Customer is responsible for privacy notices, consents, user permissions, and legal bases required for the personal information customer or its users enter into the services.

- Customer handling, transport, storage, identification, cremation, processing, packaging, return, disposal, or chain-of-custody practices.
- Any alleged loss, misidentification, commingling, incorrect return, delayed return, unauthorized disposal, mishandling, or failure to return remains, cremated remains, or memorial items.

Disclaimers
Except as expressly stated in a signed written agreement, the services are provided as is and as available. PCS disclaims warranties of merchantability, fitness for a particular purpose, non-infringement, uninterrupted operation, error-free operation, and any warranty arising from course of dealing or usage of trade to the maximum extent permitted by law.
Nothing in these Terms limits liability to the extent such limitation is prohibited by applicable law.
Limitation of Liability
To the maximum extent permitted by applicable law, PCS shall not be liable for any indirect, incidental, consequential, special, exemplary, punitive, emotional distress, reputational, loss-of-goodwill, loss-of-business, loss-of-data, or similar damages arising out of or related to customer real-world operations, chain-of-custody practices, cremation services, handling of remains, customer communications, legal compliance, or use of the services, even if PCS has been advised of the possibility of such damages.
Any aggregate liability cap, exclusions, exceptions, governing law, venue, and dispute-resolution terms should be confirmed in the applicable order form or signed written agreement.
No Third-Party Beneficiaries
The services are provided to customer for customer internal business use. Pet owners, veterinary practices, transport providers, crematories, aftercare providers, and other third parties are not third-party beneficiaries of these Terms and shall have no rights or claims against PCS arising from customer use of the services, except where such limitation is prohibited by applicable law.
Termination
Customer may stop using the services at any time, subject to any applicable subscription, payment, record export, or contractual obligations. PCS may suspend or terminate access for nonpayment, security risk, misuse, legal risk, or material breach of these Terms.
Customer should export or preserve records needed for its business before termination where possible. Certain provisions, including customer responsibility, customer data obligations, disclaimers, indemnification, limitation of liability, and no third-party beneficiaries, survive termination.
